PlumChoice Rewards Terms & Conditions

1. In General. PlumChoice currently offers a Bonus program ("the Bonus") to all PlumChoice customers. By participating in the Bonus, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

2. Customer Bonus.

i. Eligibility. This Bonus is open to all PlumChoice customers. PlumChoice reserves the right to discontinue this program at any time within thirty days of notifying customers. Should the program be discontinued, you will receive the full bonus for new customers you have referred, one-time desktop icon downloads and gift certificates you have purchased under the following terms.

ii. Persons Who May Be Referred. You must only refer PlumChoice to individuals with whom you have a pre-existing personal or business relationship (a "Family, Friend or Colleague"). Without limiting the generality of the foregoing, you must not obtain names for referral from i) group email addresses or ii) email mailing lists. You must not submit yourself for this referral bonus.

iii. No Spamming. We strictly forbid the sending of unsolicited e-mail to numerous recipients ("spamming") and any PlumChoice customer who spams other Internet users for referral bonuses will have his or her computer support account immediately and permanently terminated.

iv. Number of New Customer Referral Bonuses. For a limited time, there are no restrictions on the number of New Customer Referral Bonuses you may earn.

v. Bonus Requirements. For each customer that you refer to PlumChoice who completes the new customer bonus requirements below, we will credit a bonus, under the following guidelines, to your PlumChoice computer support account. A customer will only be deemed to have been referred for the purposes of these Terms and Conditions if:

1. They are not or have not been a PlumChoice customer at the time of the PlumChoice Referral, 2. They initiate or begin a paid computer support session with a PlumChoice computer support specialist

vi. Bonus Amount. The bonus amount is based on the following:

a. 15 FREE minutes of online computer support will be added to your account for every new customer referral initiating a computer support session with a live support representative and who pays for some level of service.

vii. Maximum Payouts. There are no maximum payouts for qualified customer referrals.

viii. Method of New Customer Referral. To receive your bonus for referring a new customer, the customer must contact a PlumChoice customer support representative via telephone and through PC connect and initiate a paid support session.

Additional Terms and Conditions

i. Bonus Period. PlumChoice reserves the right to discontinue the Bonus for any reason, at any time and for any duration at its sole discretion, and without notice.

ii. Remedies for Your Noncompliance. If PlumChoice determines in its sole discretion that you have not complied with these Terms and Conditions, it may, in addition to any other rights and remedies it may have against you, immediately and without notice to you, withdraw all benefits to you under the Bonus (including, without limitation, by cancelling or declining to credit any and all minutes issued or to be issued to you in connection with the Bonus.

iii. Limitation of Liability for Plumchoice. TO THE FULLEST EXTENT PERMITTED AT LAW, NEITHER PLUMCHOICE NOR ANY OF ITS AFFILIATES, DIRECTORS, OFFICER, EMPLOYEES, OR OTHER REPRESENTATIVES WILL BE LIABLE FOR DAMAGES ARISING OUT OF OR IN CONNECTION WITH THIS OFFER. THIS IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING (WITHOUT LIMITATION) COMPENSATORY, DIRECT, INDIRECT, OR CONSEQUENTIAL DAMAGES; LOSS OF DATA, INCOME, OR PROFIT; LOSS OF OR DAMAGE TO PROPERTY; AND CLAIMS OF THIRD PARTIES.

iv. Entire Agreement. These Terms and Conditions represent the entire agreement between you and PlumChoice with respect to the Bonus.

v. Variation of the Terms and Conditions. These Terms and Conditions may be amended or modified by PlumChoice in its sole discretion at any time and these amendments and modifications will apply to you when you use the PlumChoice service. Any such amendments will be posted to this page, and it is your responsibility to review this page from time to time for such amendments.

vi. Severance. If any provision of these Terms and Conditions is held to be invalid, such invalidity will not affect the remaining provisions.

vii. Governing Law. These Terms and Conditions will be interpreted, construed, and enforced in all respects in accordance with the laws of the State of Massachusetts, without giving effect to any principles of conflicts of laws. You hereby irrevocably consent and submit to the nonexclusive personal jurisdiction of the state and federal courts within Middlesex County, Massachusetts for the purposes of litigating any such action.
